IMPACT ON CONSUMING EXPIRED PRODUCTS:

LEGAL STEPS AND PROCEDURES DURING THE SALE OF EXPIRED PRODUCTS:

1. Checking the expiration date:
Before purchasing a product, it is important to check the expiration date and ensure that it is not expired.

2. Complaint to the manufacturer:
If you come across an expired product, you can make a complaint to the manufacturer, providing them with the details of the product and the date of purchase.

3. Complaint to the local authorities:
If the manufacturer does not take any action, you can file a complaint with the local authorities, such as the Food and Drug Administration (FDA) or the Consumer Affairs Department.

4. Legal action:
If the authorities do not take any action, you can file a case in the consumer court, seeking compensation for the harm caused by the expired product.

5. Penalties and fines:
The manufacturer or seller of expired products may be liable to pay penalties and fines under the Food Safety and Standards Act, 2006.

6. Regular inspections:
The authorities should conduct regular inspections to ensure that products are not being sold beyond their expiration date.

TO FILE COMPLAINT AGAINST SELLERS SELLING EXPIRED PRODUCTS:
  • If any Seller, Retailer or Traders, sold any expired products either accidentally or intentionally, a severe action would be taken under section 273 of the Indian Penal Code.
  • Consumer can file a complaint in the Consumer Court under Section 7 of the prevention of Food Adulteration Act 1954 is the primary legislation that deals with the safety standards when it comes to the sale of expired perishable food products.
ACTIONS AGAINST THE SELLERS:
It is even considered as an offence punishable by six months imprisonment or fine or penalty not exceeding 2 lakh rupees if such case is not injurious to health.

COMPENSATION TO THE CONSUMERS CONSUMED EXPIRED PRODUCTS:

  • Consumers who have consumed expired products may be entitled to compensation depending on the specific circumstances. 
  • Consumer may able to receive a refund or replacement from the manufacturer or retailer for the sale of expired product with the purchase bill they had during the purchase of the product.
